Waste Collection Wandsworth Service Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Wandsworth provides waste and rubbish collection services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions, which form the entire agreement between you and us for the provision of waste collection services.
If you do not agree with any part of these Terms and Conditions, you should not place a booking or allow our operatives to carry out any work at your premises. You are responsible for reading and understanding these terms before confirming your booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer, you or your means the person, company or organisation requesting and paying for the waste collection service.
Company, we, us or our means Waste Collection Wandsworth, the provider of the services described in these terms.
Services means any waste, rubbish or junk collection, removal, transportation, loading, unloading, disposal, recycling or related services provided by us.
Premises means the property, site, land or building at which the Services are to be carried out.
Waste means any items or materials that you ask us to remove, whether household, commercial, garden, construction or other waste, subject to the exclusions set out in these terms.
2. Scope of Services
We provide waste collection and removal services in Wandsworth and surrounding areas, including but not limited to household clearances, commercial waste collection, garden waste removal and general rubbish clearance.
The exact scope of the Services for each booking, including type of waste, estimated volume, access requirements, and timing, will be agreed at the time of booking or on site prior to commencement of work. We reserve the right to refuse to remove any items that are prohibited, hazardous, unsafe to handle, or not agreed as part of the booking.
We do not provide skip hire, demolition services, asbestos removal, chemical handling, clinical waste disposal, or any service that requires specialist licensing beyond our existing authorisations.
3. Booking Process
You may book our Services by telephone, email or through our online booking channels where available. When making a booking, you must provide accurate and complete information, including:
a. Your full name and contact details.
b. The address of the Premises where the Service is required.
c. A description of the Waste to be collected, including type, approximate quantity and any relevant access or parking details.
d. Your preferred date and time window for collection.
Any quote provided prior to the day of collection is an estimate only and is based on the information you have supplied. The final price will be confirmed by our operatives on arrival, after they have inspected the Waste and access conditions. If the actual volume, weight, type of waste or access issues differ from what you described, we may adjust the price accordingly or decline to proceed with the Service.
A booking is deemed confirmed once we have acknowledged it and provided you with a date and time window for the collection. We aim to attend within the agreed time window but cannot guarantee exact arrival times due to traffic, operational issues and other external factors.
4. Access and Parking
You are responsible for ensuring that our operatives have safe, reasonable and lawful access to the Premises and to the Waste to be collected. This includes:
a. Providing accurate access instructions at the time of booking.
b. Ensuring driveways, corridors, stairways and access routes are clear and safe.
c. Arranging any necessary parking permits or authorisation for our vehicle.
If our team is unable to gain access, cannot park legally within a reasonable distance, or considers the access to be unsafe, we may cancel or postpone the Service and a call-out or cancellation fee may be charged.
5. Customer Responsibilities
You are responsible for:
a. Ensuring that you have the legal right and authority to request the removal of the Waste from the Premises.
b. Separating and identifying any items that must not be removed.
c. Informing our operatives of any items that may be fragile, sharp, heavy, or otherwise potentially hazardous to handle.
d. Complying with any instructions or guidance given by our operatives regarding safety during the collection.
You must not ask our operatives to undertake any work or remove any items that are illegal to handle, unsafe, or outside the scope of the agreed Services. We reserve the right to refuse such requests.
6. Waste Types and Exclusions
We can collect most common household and commercial waste items, including furniture, appliances, general rubbish, garden waste and non-hazardous construction debris. However, the following items, without limitation, are generally excluded from our Services unless explicitly agreed in writing in advance:
a. Asbestos or materials containing asbestos.
b. Clinical, medical or biological waste.
c. Chemicals, solvents, paint, oils and industrial liquids.
d. Gas bottles, pressurised containers and certain batteries.
e. Explosives, firearms, ammunition or similar items.
f. Any waste that requires specialist treatment or licensing that we do not hold.
If prohibited or hazardous items are found amongst the Waste, we may refuse to remove them, may adjust our charges to reflect additional handling requirements, or may suspend the Service. You will remain responsible for any such items.
7. Pricing and Payment Terms
Unless otherwise agreed, pricing is based on a combination of the volume and, where applicable, weight of Waste collected, the type of material, any additional labour required, access conditions and disposal costs.
All prices will be stated in pounds sterling and may be subject to VAT where applicable. We will confirm the final price before commencing work. By allowing us to start loading, you agree to pay the stated price.
Payment is due immediately on completion of the Service, unless we have agreed credit terms with you in advance. We accept common payment methods such as cash, card or bank transfer, subject to availability at the time of collection. For business customers, invoices are normally payable within the period stated on the invoice.
If you fail to make payment when due, we reserve the right to charge interest on the overdue amount, recover all costs of collection, and suspend or cancel any further Services until payment has been made in full.
8. Cancellations and Amendments
You may cancel or amend your booking by contacting us as soon as possible. The following cancellation conditions apply:
a. If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged.
b. If you cancel within 24 hours of the scheduled collection time, we may charge a reasonable cancellation fee to cover administrative and operational costs.
c. If our operatives arrive at the Premises at the agreed time and are unable to carry out the Service due to lack of access, parking, your non-attendance where required, or any other reason beyond our control, we may treat this as a late cancellation and charge a call-out fee.
Any request to reschedule a booking is subject to availability. If we need to cancel or reschedule a booking due to operational reasons, vehicle breakdown, staff illness or severe weather, we will notify you as soon as reasonable and offer an alternative date. We will not be liable for any losses arising from such changes, save for refunding any amount you have already paid for the affected Service.
9. Service Delivery and Performance
We will use reasonable care and skill in providing the Services and will aim to complete the work promptly and efficiently. However, all timescales are estimates and not guaranteed. We do not accept liability for delays caused by events outside our reasonable control.
Our operatives may take photographs of the Waste before and after the collection for operational, health and safety, and record-keeping purposes. These images will be used in line with our privacy and data handling policies.
10. Damages and Liability
We will take reasonable care when carrying out the Services at your Premises. However, you acknowledge that the movement of large or heavy items may carry a risk of minor damage, particularly to floors, walls, door frames or fixtures, especially where access is tight or restricted.
You should take reasonable steps to protect or move any items that may be at risk before our arrival. Our liability for any damage that is directly caused by our negligence will be limited to the reasonable cost of repair or replacement, subject to the limitations set out below.
We shall not be liable for:
a. Any damage or loss arising from inaccurate information you provide, unsafe access or structural defects at the Premises.
b. Any loss of profits, loss of business, loss of opportunity or any indirect or consequential losses.
c. Any items removed in good faith where you failed to clearly identify them as not to be taken.
Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded or limited under UK law.
11. Compliance with Waste Regulations
We operate in accordance with applicable UK waste management laws and regulations, including duty of care obligations relating to the handling, transport and disposal of controlled waste. We will transport Waste only to appropriately licensed or permitted facilities for recycling, recovery or disposal.
Upon request, and where applicable, we may provide evidence that we are authorised to carry waste as required by law. You acknowledge your own duty of care to use a reputable and lawful waste carrier and to provide accurate information about the nature of the Waste.
By engaging our Services, you confirm that the Waste being collected is not from any illegal activity and does not include items that are prohibited by law. If we suspect that Waste is unlawful or improperly described, we may refuse collection and report the matter to the relevant authorities.
12. Complaints
If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing details of the issue and any supporting information. We will investigate the matter and aim to respond within a reasonable timeframe.
Where a complaint is justified, we may, at our discretion, offer to rectify the issue, provide a partial refund, or take other appropriate action. This does not affect your statutory rights.
13. Data Protection and Privacy
We will collect and process your personal data only for the purposes of managing your booking, providing the Services, handling payments, and maintaining our records. We will take reasonable steps to keep your information secure and will not share it with third parties except where necessary to deliver the Services, comply with legal obligations or enforce our rights.
14. Variations to these Terms
We may update or amend these Terms and Conditions from time to time to reflect changes in the law, regulatory requirements or our business practices. The terms that apply to your booking will be those in force at the time you confirm your booking, unless we agree otherwise in writing.
15. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by any court or competent authority, that provision will be removed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste collection services.
17. Entire Agreement
These Terms and Conditions, together with any written confirmation of your booking and any agreed variations, constitute the entire agreement between you and us in relation to the Services. You acknowledge that you have not relied on any statement, promise or representation not set out in these Terms and Conditions.
